Premise:

The offer and sale of products under the NEIRAMI brand on the "shop.neirami.it" website, in use at the company "DITRAVERSO S.R.L." are governed by the following General Conditions of Sale.

The products purchased on shop.neirami.it are sold directly by DITRAVERSO S.R.L., with registered office in Italy, via De' Carbonesi 3CD - 40123 Bologna - Italy, C.F. e P.IVA n. 04080601208, REA No. BO: BO-567652.

Within the reserved area, the customer can find information about their current order, shipments, refunds and returns of products purchased on

shop.neirami.it

The customer and anyone interested in having news about the products and services on the site shop.neirami.it can contact DITRAVERSO S.R.L., by e-mail to info@neirami.it .

For any other legal information, please consult this document and the Privacy Policy.

DITRAVERSO S.R.L. reserves the right to update, at any time, these General Conditions of Sale.

Art. 1: Object

These General Conditions of Sale of shop.neirami.it define the rights and obligations of the parties in the sale of products and services carried out by DITRAVERSO S.R.L. (hereinafter defined as the Seller) to customers of the website shop.neirami.it.

Through the purchase or booking of a product or service (hereinafter referred to as an order), the customer declares that he is over 18 years of age and is a consumer within the meaning of art. 3 of the D. Lgs. 206/2005 (Consumer Code) and to be the owner or have the availability of an e-mail address communicated to shop.neirami.it. Each customer declares to have read and accept the rights and obligations that result from placing the order. All orders are governed by these General Conditions of Sale.

The General Conditions of Sale do not regulate the provision of services or the sale of products by subjects other than the Seller that are present on shop.neirami.it through links, banners or other hyperlinks.

DITRAVERSO S.R.L. advises, before placing orders and purchasing products and services from subjects other than the Seller, to check their conditions of sale, because the Seller is not responsible for the provision of services by third parties other than the Seller or for the conclusion of electronic commerce transactions between shop.neirami.it users and third parties.

These General Conditions of Sale fully comply with the "EU Code of Online Rights" drawn up by the European Commission and published by the Publications Office of the European Union, in force since 2012.

Art. 2: Customer

DITRAVERSO S.R.L. offers for sale, on shop.neirami.it, the products and carries out its electronic commerce activity exclusively towards its end users who are "consumers". By the term "consumer" we must mean and identify the subject identified in article 3, letter a) of D. Lgs. 206/2005.

The term "consumer" identifies the natural person who acts on shop.neirami.it for purposes not related to its commercial, entrepreneurial or professional activity, possibly carried out. Those who are not a "consumer", are invited to refrain from concluding commercial transactions through shop.neirami.it.

In view of its commercial policy, the Seller reserves the right not to follow orders from parties other than the "consumer" or in any case orders that do not comply with its commercial policy.

The resale or distribution of NEIRAMI branded products purchased on shop.neirami.it is strictly prohibited.

Art. 3: Method of placing the order, prices and invoicing

Access to the sales services offered by shop.neirami.it is possible upon spontaneous registration or even on invitation from a Customer or directly from DITRAVERSO S.R.L. To conclude the contract for the purchase of one or more products on shop.neirami.it, the Customer must fill in the order form in electronic format and send it to the Seller, by electronic means, following the corresponding instructions.

The order form contains a reference to these General Conditions of Sale in force, and a summary of information on the essential characteristics of each product ordered and its price (including all applicable taxes or duties), the means of payment that the Customer may use to purchase each product and the delivery methods of the products purchased, shipping costs and delivery, a reference to the conditions for the exercise of his right of withdrawal and the modalities and time of return of the products purchased.

Before purchasing the products, by sending the order form, the customer will be asked to read carefully the General Conditions of Sale paying attention to the articles reserved for the right of withdrawal, to print a copy of it through the print command and to store or reproduce a copy for their own personal use.

The order form will be stored for the period of time necessary to fulfill the orders and in any case within the terms of law. Each customer will be able to access his order form, by consulting the section My Account of the website shop.neirami.it.

Before sending the order form, you will also be asked to identify and/or correct any data entry errors.

The language available to conclude the contract with the Seller is Italian.

Versions in languages other than Italian may be provided, but only for comparative purposes, as per art. 10 of these General Conditions of Sale. The legal and interpretative references must be exclusively those expressed in Italian.

Once the order form has been sent, the Seller will take over the purchase order placed by the customer.

The Seller may not give effect to purchase orders made by customers who do not provide sufficient guarantees of solvency or which are incomplete or incorrect, or in case of unavailability of products. In these cases, the Seller will inform the customer by e-mail that the contract has not been concluded and that the Seller has not acted on his purchase order, stating the reasons.

If the products, presented on shop.neirami.it, are no longer available or for sale at the time of the last access to the site or the sending of the order form, it will be the responsibility of the Seller to communicate to the customer, promptly and in any case within thirty (30) days from the day following that in which the order will be transmitted to the Seller, the eventual unavailability of the products ordered. In case of sending the order form and payment of the price, the Seller will reimburse the amount already advanced by the customer. The refund will be made according to the procedures provided for in point 8.2 of the General Conditions of Sale.

With the electronic transmission of the order form, the customer unconditionally accepts and undertakes to observe these General Conditions of Sale in his dealings with the Seller. If the customer does not agree with some of the terms in the General Conditions of Sale, DITRAVERSO S.R.L. invites him not to submit the order form for the purchase of products on shop.neirami.it.

With the transmission of the order form, the customer confirms to know and accept the General Conditions of Sale and the additional information contained in shop.neirami.it, also recalled through links.

The Order will be considered final and the contract concluded, at the time when the Customer receives the order confirmation email from shop.neirami.it, provided that the products will be shipped after verification of the credit of the sums paid by the customer.

Upon conclusion of the contract, the Seller will send, by e-mail, a receipt of the purchase order, containing a summary of the information already contained in the order form (information on the essential characteristics of the product and details of price, means of payment and delivery costs).

To ensure a better quality of service and greater availability of products, DITRAVERSO S.R.L reserves the right to limit the number of products that can be purchased by each customer on shop.neirami.it.

The prices of the products are indicated in Euro, refer to the goods only and are inclusive of all taxes applicable to the sale. They are valid for the following territories and/or Eurozone countries in addition to Italy: Austria, Belgium, Cyprus, Estonia, Finland, Metropolitan France and Corsica, Germany, Greece, Ireland, Luxembourg, Malta, Netherlands, Poland, Portugal and Madeira, Slovak Republic, Slovenia, Spain - Canary and Balearic Islands.

For countries outside the Eurozone, Bulgaria, Croatia, Denmark, Latvia, Lithuania, Poland, Northern Ireland, Czech Republic, Romania, Sweden and Hungary, the prices of products and shipping costs are always indicated in Euro and include all applicable taxes. Before making a purchase, the customer must verify the value in his national currency; this will not have any commercial value.

Art. 4: Conformity of products for sale on shop.neirami.it

On shop.neirami.it are offered for sale exclusively products of collection referring to the brand NEIRAMI of first quality. The materials with which the products on shop.neirami.it are made are produced directly by the Seller.

The Seller does not sell used, irregular or inferior products to the corresponding standards offered on the market.

The essential characteristics of the products are presented on shop.neirami.it within each product sheet.

The images and colors of the products offered for sale on shop.neirami.it may not correspond to the real ones due to the effect of the Internet browser and the monitor used.

Product prices may be subject to updates. The customer is requested to confirm the final selling price before submitting the order form.

The Seller, in case of exercise of the right of withdrawal, has the right not to accept the return of products that are missing the corresponding label or that have been altered in their essential and qualitative characteristics or that have been damaged.

Art. 5: Payments

For the payment of the price of the products and their shipping and delivery costs, the customer may follow one of the available methods indicated in the order form (credit card, Paypal, bank transfer).

The debit on the bank account of the Customer will take place 24 hours after the date of placing the Order and the Order will be considered effective only after the approval of the banking payment centers. In the event that payment is made through PayPal, the debit or refusal will be immediate.

Furthermore, this information will never be used by the Seller except to complete the procedures related to the purchase and to issue the corresponding refunds in case of possible returns of the products, following the exercise of the right of withdrawal, or if it is necessary to prevent or report to the police the commission of frauds on shop.neirami.it.

According to the provisions on Privacy, shop.neirami.it does not store the bank details of the Customer to ensure greater security in the processing of personal data.

The payment by bank transfer can be made to the current account of DITRAVERSO S.R.L at EMILBANCA with IBAN IT34K0707202408000000726899, BIC code ICRAITRRTS0, within 5 (five) working days from the date of confirmation of the order; if the transfer is not made within this period, the contract shall be considered automatically terminated and ineffective and the Customer will receive an email cancelling the order. In any case, the products will be shipped only after DITRAVERSO S.R.L sees the credit on its current account.

The Customer is required to record and print payment details if he wishes to retain his bank transaction details.

Art. 6: Availability of products

In case of total or partial unavailability of the product after the transmission of the Order, the Customer will be informed by e-mail of the cancellation of the Order or of the partial delivery of the Order.

In case of unavailability of the product, the Customer will be entitled to request:

• the delivery of an identical product or service of equivalent quality and price consistent with stock availability; or

• the refund of the price of the product or service ordered within thirty (30) days from the request made by the Customer.

Art.7: Delivery of the products

Place of delivery

The products or services will be sent to the delivery address that the Customer has indicated during the process of the Order. The participation in the costs for the preparation and shipment of the Order include VAT. The Customer will be notified of the shipment by e-mail.

The products and/or services will be accompanied by a Transport Document indicating what is contained in the package.

DITRAVERSO S.R.L. delivers its products in Italy, including islands, using the shippers UPS, BRT, DHL or other offering a similar service.

DITRAVERSO S.R.L delivers its products in the following countries at a cost of Euro 15,00 to be borne by the Customer: Austria, Belgium, Croatia, Denmark, Finland, Metropolitan France and Corsica, Germany, Greece, Ireland, Luxembourg, Netherlands, Portugal and Madeira, United Kingdom and Northern Ireland, Spain - Canary and Balearic Islands, Sweden.

DITRAVERSO S.R.L. delivers its products to the following countries at a cost of Euro 25,00 charged to the Customer: Bulgaria, Cyprus, Estonia, Latvia, Lithuania, Malta, Poland, Romania, Czech Republic, Slovakia, Slovenia, Hungary.

Potential customers residing in other countries than those mentioned above should contact the customer service DITRAVERSO S.R.L. at info@neirami.it and check with the Seller the possible ways of purchase and shipping the products.

Time limit for delivery

The maximum time limit for delivery is twenty working days (excluding Saturdays, Sundays and public holidays) from the date of the order, unless otherwise indicated to the customer before the final confirmation of the order. In this case shop.neirami.it will indicate to the customer a different delivery time.

In the section My Account of the website shop.neirami.it. the Customer can view the status of his order.

Delay in delivery

In case of delay in delivery, the Customer can contact the Customer Service of shop.neirami.it at the email address info@neirami.it

Failure to deliver

The Customer has the right to cancel the Order if delivery has not taken place within ten working days following the delivery date indicated by shop.neirami.it, unless the non-delivery is due to force majeure.

Within thirty (30) working days following the request for cancellation of the Order submitted by the Customer, DITRAVERSO S.R.L will arrange the refund in favor of the Customer.

Delivery made

Each delivery is deemed to have been made when the product or service is made available to the Customer by the carrier.

Customers will be able to track the shipment of the package by contacting our customer service directly.

Without prejudice to the right of withdrawal granted to the Customer pursuant to art. 8, it will be the responsibility of the Customer to verify the shipment at the time of its arrival and make all reservations and disputes that it considers justified as well as refuse the package if it finds that it may have been opened or if the package should present obvious traces of deterioration. Such disputes must be indicated on the delivery note and communicated to shop.neirami.it by sending a communication to the Customer Service, reachable at info@neirami.it , within the working day (24 hours) following the delivery of the Order.

If the courier does not allow to put the dispute on the delivery note, then the customer is asked to reject the goods.

The Customer Service of shop.neirami.it will then open an investigation with the carrier. The Client will receive an e-mail message informing him that an investigation has been opened. The response time of the carrier to shop.neirami.it is generally 30 working days.

7.1: Information on delivery methods

Lost package

In case of loss of the package, the Customer must contact the Customer Service of shop.neirami.it without delay by writing an email to the e-mail address info@neirami.it. The Customer Service of shop.neirami.it will then open an investigation at our adopted national or international carrier. The Client will receive an e-mail message informing him that an investigation has been opened. The response time of the carrier to shop.neirami.it is generally 30 working days.

If the package is found within 30 days of the opening of the investigation, it is sent to the Customer: the delivery procedure then follows its normal course (delivery of the package or notice of passage, etc.).

If the package is declared lost shop.neirami.it will notify the customer and immediately proceed to the completion of the formalities for the refund of the order (product and shipping costs).

Art. 8: Right of withdrawal

The purpose of DITRAVERSO S.R.L. is to ensure complete customer satisfaction. If for any reason the customer believes that he is not satisfied with his order can exercise its right of withdrawal, without penalty, within ten (10) working days from the day on which the customer has received the products purchased on shop.neirami.it .

The products to be returned must be shipped within 10 working days of their receipt. The products can be returned by sending the package by courier chosen by the Customer and at his expense, only after filling out the return form available online in the Customer Service area to obtain the return number.

8.1.: Conditions for exercising the right of withdrawal

The right of withdrawal is properly exercised if the following conditions are fully met:

• the Return Form must be correctly completed and sent electronically to shop.neirami.it within ten (10) working days from the date of delivery.

• the products must not have been used, worn, washed or damaged;

• the products must be returned in their original packaging, in perfect state of resale (in the case of design objects, fashion accessories, the packaging must be sealed as originally);

• the products returned by Customers must be sent to in a single shipment, via the courier service chosen by the customer within 10 working days from the date of receipt. DITRAVERSO S.R.L., in fact, reserves the right not to accept items of the same order, returned and shipped at different times

If the Customer has met all the required conditions, DITRAVERSO S.R.L will refund the price of the products purchased, leaving the Customer to bear only the costs of the return, that is to say those for the return to DITRAVERSO S.R.L of the products purchased.

The Customer will be contacted if the return cannot be accepted because it does not comply with the conditions above. In this case, the Customer may choose to have the purchased products back at his own expense.

If the customer refuses this shipment DITRAVERSO S.R.L reserves the right to retain the products and the corresponding amount for the purchase of the products.

8.2: Time and method of reimbursement

After DITRAVERSO S.R.L. has received the return and checked that all requirements have been met, the Customer will receive an e-mail confirming acceptance of the return.

Whatever the payment method used by the Customer (credit/debit card, bank transfer, Paypal), the refund is activated by DITRAVERSO S.R.L in the shortest time possible, and in any case within thirty (30) days from the date on which it became aware of the exercise of the right of withdrawal, once it has been verified that the withdrawal has taken place in compliance with the conditions set out above.

The actual time for the refund or return of the sums paid for the purchase of the products depends on the payment methods used:

• Credit/debit card purchase: the time it takes to view the refund depends on the institution that issued the card. We remind you that the value date of the credit is the same as the debit, so the customer will not suffer any loss in terms of bank interest.

• purchase via PayPal: the refund will be made to the Customer’s PayPal account and will be immediately visible. The actual refund to your credit card from PayPal account depends on the institution that issued the card.

• payment by bank transfer: the refund is made on the current account indicated by the Customer, so the repayment time depends on the correctness of the data provided by the customer; normally the credit is within thirty (30) days.

In case of gift, the refund will be made to the person who made the payment.

Any refunds will be handled through the same payment method with which you made the purchase.

8.3: Product identification card

All products offered for sale on shop.neirami.it are provided with an identification tag, which is an integral part of the goods. The customer is invited to try the product without removing the tag because it will not be accepted returned products that are not equipped.

Art. 9 - Intellectual Property

The content of the shop.neirami.it website (including logos, trademarks, illustrations, photographs, etc...) is protected in accordance with Italian law on copyright, trademarks and other intellectual property rights. The elements presented on this site are subject to change without prior notice and are made available without warranty of any kind, explicit or tacit, and may not give rise to any claims for damages.

No content from the shop.neirami.it website may be copied, reproduced, published, downloaded, returned, transmitted or distributed in any way, except in the case of a simple recording of documents on a single computer for the sole personal use of the person who made the copying and for non-commercial purposes. In any case, the proprietary terms must always be kept intact. The modification of these contents or their use for other purposes constitutes a violation of the property rights of shop.neirami.it.

In particular, it is forbidden to use such content on another website or in a computer space on the network. Simple links to the home-page of shop.neirami.it are allowed.

The following shall be prohibited:

• The automatic insertion links (deep linking or online linking) that allow the internet user to automatically display in a specific space the contents coming from the website of shop.neirami.it;

• The link-box (framing) that allow a page of the shop.neirami.it website to appear in a box placed within the page of the website visited by the internet user.

In any case, links coming from sites that are contrary to morality, violent, pornographic or paedophile content, that do not respect the dignity of the individual or intended to show or sell objects, substances and/ or illegal works.

The existence of a hypertext link from a third party site and directed to the website of shop.neirami.it does not imply in any case a collaboration between shop.neirami.it and this site. shop.neirami.it does not exercise any control over the websites of third parties and therefore assumes no responsibility for the contents, products, services, information, materials, software of the sites that contain a hyperlink to the website of shop.neirami.it.

The shop.neirami.it website may contain links to shop.neirami.it partner websites or third party sites. shop.neirami.it does not exercise any control over these sites and therefore assumes no responsibility for the availability of such sites, their content, advertising and products and/ or services available on or from such sites. shop.neirami.it will not be liable in any way for any direct or indirect damages that may be caused by the Internet user’s access to the partner’s website and/or third parties and the use of the contents and services of this site by the Internet user.

Art. 10: Jurisdiction - Applicable law

The General Conditions of Sale are drawn up in Italian language, are governed by Italian law and in particular by Legislative Decree 6 September 2005 n. 206 on the consumer code, with specific reference to the legislation on distance contracts and Legislative Decree no. 70 of 9 April 2003 on certain aspects concerning electronic commerce.

For any legal dispute that may arise about the interpretation and/ or execution and/ or termination of the Contract and/ or these General Conditions, will be exclusively competent the Court of Bologna and the Italian jurisdiction will exist.

The General Conditions of Sale are amended from time to time also in consideration of possible changes of regulations. The new General Conditions of Sale will be effective from the date of publication on the website shop.neirami.it.

For any doubts regarding the interpretation of the Contract and/or these General Conditions, reference shall be made exclusively to the Italian version.
